1 Information

If you send enquiries or any other information ("Submissions") to our Web site, these will be treated as non-confidential. Your Submissions should not be or contain, material that is offensive, pornographic, defamatory, blasphemous, unlawful or likely to infringe any applicable law, whether civil, criminal or religious. Material submitted should be original to you and not copied in whole or part from any third party.

4 Sale and Purchase

The contract in respect of the goods supplied by us to you comes into existence when we have accepted your order in accordance with these terms and conditions. Receipt of an order via our site does not constitute acceptance of an order.

5 Price

2.1 All prices are quoted in pounds Sterling unless otherwise specified.

2.2 Prices are correct at the time of order and relate to Internet purchases only. All orders for goods are subject to availability and we reserve the right to refuse to supply.

6 Payment

Payment must be made in pounds Sterling by major credit or debit card. We accept Visa, Master Switch and JCB. Refunds on debit cards will be by cheque.

7 Ownership Ownership of goods will remain the property of A.T.H (Hydraulics) Ltd until full payment has been made by you and has been received by us.

8 Delivery

8.1 It is our policy to try to fulfil all orders next working day. If any goods are not available at the time of your order we will notify you of the revised delivery. Following your acceptance of the revised delivery goods will be sent to you, as soon as possible.

8.2 All deliveries must be signed for upon receipt.

8.3 You bear the risk once the goods have been signed for.

9 Acceptance

9.1 You will inspect goods within a reasonable time after their receipt. We consider a reasonable time to be seven workings days beginning on the day after delivery of the goods.

9.2 You will be deemed to have accepted the goods unless during the time set out in paragraph 9.1 you notify us that the goods are rejected. If no notification is received, we will consider the goods being as described of satisfactory quality and fit for purpose, and may not accept any rejection at a later date.

10 Returns Procedure

10.1 If goods are to be rejected or your order cancelled you will comply with the returns procedure as set out in paragraphs 10.2 or 10.3. We will only accept returns which:

Are rejected due to a defect or discrepancy between the ordered and delivered goods. When the return arrives back at our office it will be assessed to confirm that the rejection is valid, if so the return delivery charge set out in paragraph 10.2 will be credited back to you.

You have cancelled the order in which case only non-bespoke goods will be credited back to you, a 20% handling charge will be made.

All returns must be accompanied by a valid proof of purchase.

10.2 You can contact us by post, facsimile, telephone, or email at the address or number on the home page of this site with details of your original order number and receipt, we will arrange to collect the return. Subject to the provisions of paragraph 10.1, your credit or debit card will be debited with the cost of the return delivery charge.

10.3 Alternatively you can return your purchase to us.

11 General

11.1 Deliveries for goods from our Web site are for mainland United Kingdom. If you require delivery outside this geographical area please E-mail an enquiry.

11.2 If any part or parts of these terms and conditions are deemed invalid, void or unenforceable, then that part or those parts will be considered removable from these terms and conditions thereby not preventing the remainder from being enforceable or effective.

11.3 These terms and conditions may be revised at any time and we reserve the right to do so. You are, therefore advised to keep up to date with the contents of these terms and conditions as revisions are binding upon you.

11.4 Nothing in these and conditions will reduce your statutory rights relating to faulty or miss described goods. For further information about your statutory rights contact your local authority Trading Standards Department or Citizen's Advice Bureau.

11.5 Your use of our Web site and any purchase of goods through our Web site will be governed by English Law and will be deemed to have occurred in mainland United Kingdom.
